Part 46 vs Part 48: research fit matters

Part 46 and Part 48 are useful starting filters for MSHA training-record research. Neither tells you, by itself, whether an operator needs your services.

Mine Citation Scout research guide · Updated September 19, 2026

Do not equate surface mining with Part 46

Part 46.1 defines the scope of Part 46, including specified sand, gravel, stone, clay and related surface operations. Part 48.21 covers surface mines and surface areas of underground mines subject to its stated scope and exceptions. The word “surface” is not enough to choose a training program.

Match the topic, not just the part

Source sectionResearch topicWhat not to assume
46.5New miner trainingNot automatic evidence of an annual-refresher purchase.
46.7New task trainingNot proof that a general course addresses the cited task.
46.8Annual refresher trainingNot evidence that outside services are wanted.
46.11Site-specific hazard awarenessNot interchangeable with a generic refresher offering.

These are research labels, not a determination of what would satisfy an operator's obligations. Read the full current section, relevant facts and qualifications before offering professional services.

Apply three fit checks

  1. Capability

Does your actual experience and authorization cover the topic and mine setting? Keep unverified credentials or uncertain delivery methods out of the offer.

  2. Practical coverage

Can you serve the facility's territory in the format required? A trainer's broad website footprint does not prove willingness to travel to one particular location.

  3. Current context

Has the action terminated? Does the operator already provide training internally? Do you have a legitimate public business contact route? An apparently relevant record can still be a poor prospect.

How we use these distinctions

Mine Citation Scout asks for your training focus and territory before preparing a sample. The proposed briefing keeps the exact source section, status and fit note visible. We do not relabel every training-related record as a qualified lead or pad a low-volume territory with unrelated topics.
